Please read these Terms & Conditions ("Terms") carefully before using the Nord Young, LLC website or engaging our services. By accessing our website or engaging our services, you agree to be bound by these Terms, together with our Privacy Policy and Accessibility Statement. If you do not agree, you must not use our website or engage our services.

1. Acceptance of Terms

By using this website or engaging Nord Young, LLC ("Nord Young," "we," "us," or "our") for any of the services described below, you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Accessibility Statement. These Terms apply to all Nord Young services, not to insurance brokerage services alone.

2. About Nord Young and Our Role

Nord Young is an independent brokerage and advisory firm serving the maritime and commercial sectors. We act as an intermediary between our clients and third parties such as insurance carriers, fuel suppliers, and other counterparties. We are not an insurance carrier, an underwriter, a fuel supplier, or a lender. We represent our clients’ interests and are not owned by, employed by, or exclusively affiliated with any single carrier or supplier.

3. Services Provided

Subject to applicable licensing and to any separate written service agreement, Nord Young’s services may include the following:

​

  • Insurance Brokerage: Placement and servicing of marine and commercial property and casualty insurance, including hull and machinery, protection and indemnity, cargo, and general commercial lines.

  • Claims Advocacy and Support: Assistance with claim preparation, documentation, and advocacy with carriers, including standalone claims handling engaged separately from a brokerage relationship.

  • Compliance, Risk, and Advisory Services: Sanctions and trade compliance screening, contract review and analysis, Subchapter M and Towing Safety Management System (TSMS) consulting, loss control and risk engineering, and policy review.

  • Energy Solutions: Bunker brokerage on a broker-intermediary basis, connecting clients with third-party fuel suppliers.

We do not underwrite insurance, issue policies, supply or take title to fuel or other commodities, or extend credit. All insurance coverage is issued by third-party carriers. All fuel and energy products are supplied by third-party suppliers under separate agreements between the client and the supplier.

Certain services described on our website are offered subject to buildout, licensing, or a separate agreement, and may not be available in all locations or at all times. The availability of any service is confirmed in your individual engagement.

4. No Requirement to Purchase Additional Services

Each Nord Young service may be engaged independently. Engagement of any one service is never conditioned on the purchase of another. In particular, the placement, renewal, or servicing of insurance is not contingent on your purchase of bunker brokerage, compliance, consulting, or any other Nord Young service, and no additional service is required as a condition of obtaining insurance coverage. You are free to engage any service on its own.

5. Nature and Limits of Our Role

Information provided on this website or in consultations is for general informational purposes only and does not constitute professional advice tailored to your specific situation. Each situation is unique and requires individual assessment.

Our compliance, sanctions, and consulting services, including trade compliance screening, contract review, and Subchapter M and TSMS consulting, are advisory and informational only. They do not constitute legal advice or a legal opinion, and they do not guarantee compliance with any law or regulation. You remain solely responsible for your own regulatory and legal compliance and should consult qualified legal counsel before making decisions.

Nord Young is not a financial or investment advisory firm and does not provide investment advice.

Our claims advocacy and support is provided in our capacity as broker and client advocate. It is not public adjusting, loss adjusting, or legal representation, and we do not make coverage determinations. All coverage decisions rest with the insurance carrier.

We recommend reviewing all policy documents, contracts, and supplier agreements with qualified professionals, including legal and financial advisors, before entering into them.

6. No Guarantee of Coverage or Outcomes

While we work diligently on your behalf, we do not guarantee any of the following:

​

  • That insurance coverage will be available for all risks, or that any specific carrier will approve an application.

  • That quoted premiums or terms will remain unchanged.

  • That any claim will be paid, or that any particular claim, compliance, regulatory, or commercial outcome will be achieved.

  • The availability, price, quantity, quality, or specification of any fuel or commodity, or the performance or solvency of any carrier or supplier.

Insurance carriers make final underwriting decisions and may decline coverage or modify terms. Suppliers make final supply and product decisions.

​

7. Energy and Bunker Brokerage

When providing bunker or other energy brokerage, Nord Young acts solely as a broker and intermediary. We do not buy, sell, supply, or take title to fuel or any commodity, we do not extend credit, and we do not assume payment or performance risk in the underlying transaction.

Any contract for the supply of fuel or other products is formed directly between you and the supplier, on the supplier’s terms. Nord Young is not a party to that contract.

​

We do not guarantee product availability, price, quantity, quality, or conformity to specification (including ISO 8217), delivery timing, or the performance or solvency of any supplier. Any dispute regarding product, quantity, quality, delivery, or payment is between you and the supplier. We may assist in facilitating communication but assume no liability for the transaction or its outcome.

8. Sanctions and Trade Compliance

You represent and warrant that you are not, and are not owned or controlled by or acting on behalf of, any person or entity subject to sanctions administered by the U.S. Office of Foreign Assets Control (OFAC), the United Kingdom, the European Union, the United Nations, or any other applicable authority, and that your transactions do not violate applicable sanctions, export control, or anti-money-laundering laws.

You are solely responsible for your own compliance with these laws. Any screening or compliance service we provide is advisory and informational, does not constitute legal advice, and does not relieve you of your obligations or guarantee compliance.

You agree to cooperate with our due diligence, including our due diligence questionnaire, and to provide accurate and complete information. We may decline, suspend, or terminate any engagement or transaction that we believe may involve sanctions, export control, or other legal risk, at any time and without liability.

9. No Attorney-Client or Fiduciary Relationship

Use of this website or engagement of our services does not create an attorney-client relationship, a fiduciary relationship, or any special duty beyond our obligations as a broker under applicable law. While we advocate for our clients in securing coverage and handling claims, our role is limited to the brokerage and advisory services described in these Terms.

10. Client Responsibilities

As a client, you agree to:

​

  • Provide accurate, complete, and truthful information in all applications, questionnaires, and communications.

  • Disclose all material facts relevant to insurance coverage or to any transaction we facilitate.

  • Cooperate with sanctions, trade compliance, and other due diligence requests.

  • Review all policy documents, contracts, and supplier agreements carefully upon receipt.

  • Pay premiums, supplier invoices, and agreed fees in a timely manner.

  • Notify us promptly of any change that may affect your coverage or a transaction.

  • Comply with all terms and conditions set by the carrier, supplier, or other counterparty.

Failure to provide accurate information or disclose material facts may result in denial of coverage or claims, or in the termination of an engagement.

11. Compensation and Payment Terms

Nord Young is typically compensated through commissions or brokerage paid by insurance carriers, fuel suppliers, or other counterparties for business we place. Such commissions are earned by Nord Young upon placement and are not refundable to clients.

​

Where we charge a separate fee for a service, that fee will be set out and agreed in writing in your individual service agreement or invoice before the service is provided. Insurance premiums are paid directly to carriers, and supplier invoices are paid directly to suppliers, unless otherwise agreed in writing. We may suspend services for non-payment of agreed fees. We will disclose our compensation where required by law.

12. Cancellation and Termination

Either party may terminate an engagement at any time with written notice. Termination does not affect:

​

  • Your obligation to pay for services already rendered and fees already earned.

  • Insurance policies or supply contracts already in force, which remain governed by their own terms.

  • Our right to receive commissions on business placed prior to termination.

​

13. Limitation of Liability

To the fullest extent permitted by law, Nord Young, LLC, its owners, employees, and agents shall not be liable for:

​

  • Any indirect, incidental, consequential, punitive, or exemplary damages.

  • Loss of profits, revenue, business opportunities, or data.

  • Damages resulting from carrier or supplier decisions, policy denials, claim disputes, or product or delivery disputes.

  • Errors or omissions in information provided by third parties, including carriers and suppliers.

  • Any damages arising from your use of this website or our services.

Our total liability for any claim arising from our services shall not exceed the total fees paid to Nord Young for the specific service giving rise to the claim.

​

14. Indemnification

You agree to indemnify, defend, and hold harmless Nord Young, LLC, its owners, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

​

  • Your use of our website or services.

  • Your violation of these Terms.

  • Your violation of any applicable law or regulation, including sanctions, export control, and anti-money-laundering laws.

  • Any inaccurate or misleading information you provide.

  • Any transaction between you and a carrier, supplier, or other counterparty, and any third-party claim related to your business operations.

15. Errors and Omissions Insurance

Where required by applicable law, Nord Young maintains Errors and Omissions (E&O) insurance covering professional liability arising from its brokerage services, subject to the terms, conditions, and exclusions of that policy.

16. Data Security and Privacy

Nord Young uses a client relationship management system and related tools to store and manage client information. We apply reasonable and appropriate technical and organizational measures designed to protect that information, including access controls and encryption of data in transit and, where applicable, at rest.

​

No method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security. You acknowledge the inherent risks of online communication. How we collect, use, store, and share personal information is described in our Privacy Policy, which forms part of these Terms.

17. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Nord Young, LLC or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission.

18. Website Use and Restrictions

You agree not to:

  • Use this website for any unlawful purpose.

  • Attempt to gain unauthorized access to our systems or networks.

19. Third-Party Carriers, Suppliers, and Links

Our services connect you with third-party carriers, suppliers, and counterparties, and our website may contain links to third-party websites. We are not responsible for the content, accuracy, practices, products, or performance of these third parties. Your dealings with any carrier, supplier, or third-party website are at your own risk and are subject to their own terms and conditions.

20. Licensing and Regulatory Compliance

Nord Young, LLC transacts insurance business only in states where it and its designated producers hold active insurance licenses. Insurance services are offered only in those states. [Currently: Tennessee, Texas, Louisiana, Mississippi, Alabama]

Where coverage is placed through the surplus lines (non-admitted) market, that coverage may not be protected by state guaranty funds, and we will disclose surplus lines placements as required by law. We comply with applicable federal and state regulations governing the services we provide, including licensing, disclosure, and consumer protection requirements.

21. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. Any dispute arising from these Terms or our services shall be resolved through the following steps, in order:

​

  1. Good faith negotiation between the parties.

  2. Mediation, if negotiation fails.

  3. Binding arbitration in Knox County, Tennessee, if mediation fails.

  4. Litigation in the state or federal courts of Tennessee as a last resort.

​

To the extent permitted by law, you agree to waive any right to a jury trial in any dispute arising from these Terms.

​

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between you and Nord Young regarding your use of our website and our services. In the event of a conflict between these Terms and a signed service agreement, the signed service agreement controls for that engagement.

24. Amendments

We reserve the right to modify these Terms at any time. Changes are effective upon posting to this website with an updated "Last Updated" date. Your continued use of our website or services after any change constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.
